1.-LL. ID 22-613 Actions Pertaining to the Acquisition of property at 1247 North Wishon (APN 451-265-02) and 777 East Olive Avenue (APN 451-265-03) 1. Adopt a finding of Categorical Exemption pursuant to Section 15301/Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA) guidelines for the project. 2. Approve a Resolution Establishing a Policy for the Preservation and Use of the Tower Theatre Property and Authorizing Purchase of the Tower Theatre Property. 3. Approve a Joint Litigation, Defense, and Indemnity Agreement by and between the City of Fresno, the Tower Theatre Entities and Sequoia Brewery 4. Approve a Purchase and Sale Agreement and Joint Escrow Instructions by and between City of Fresno, Tower Theater Productions, Fidelity National Title Insurance Company, and Tower Theatre Productions for the Performing Arts for real property at 1247 North Wishon (APN 451-265-02) and 777 East Olive Avenue (APN 451-265-03) for $6,500,000. 5. Approve a Purchase and Sale Agreement and Joint Escrow Instructions by and between City of Fresno and J&A Mash & Barrell, LLC., and Fidelity National Title Insurance Company for a portion of the real property at 777 East Olive Avenue (APN 451-265-03) for $1,200,000.

    The city’s interference with a private property sale is wrong, sets a dangerous precedence and the city council should be held accountable for their egregious actions. This in no way should be legal and is not what I want to be paying for with tax money! How does Sequoia get a loan from the city and that is ok!? Ridiculous!

    I support the city owning the tower theatre!! Please don’t let Adventure Church disrupt what a safe haven the Tower district is for the LGBTQ and artistic communities!

    The city is setting a bad precedent Interfering with the sale of private property. It has no reason to get involved and interfere with the sale, Diverting millions in tax dollars that could be put to better use.

    I absolutely do not support the city of Fresno using my tax dollars for lawyers fees. Our church in the tower theatre has been the best thing that has happened here in fresno. GOD will have the final say so in all this🙌

    I do not support the theater being bought by the City. The City doesn’t even take care of what it already owns. Their trash can is already full and the tower theater doesn’t belong in it.

    I support Adventures purchase. The city has no place in this purchase and should take its hands off of private dealings!

    Strongly oppose. It is illegal for the city to interfere with a private sale. The illegal and fraudulent activity of the city council members will be exposed.

    I do not support the City purchasing the Tower Theater. The City cares about this theatre as much as it does the homeless who sleep under its marquee.

    The church seems to be making a legal sale and this is a waste of tax payer money for the city to purchase a building that could be privately owned. This has nothing to do with the sale of a private property. If this was a church trying to stop a bar from purchasing property this would be a Supreme Court issue. The fact that the city would be willing to step in and spend so much money on an issue it has no right in is embarrassing and unethical.

    I strongly oppose the sale of tower theater to the city of Fresno. The city of Fresno can’t even take care of the buildings it does own. I’m ashamed of our city council and the lies that come from them. They should focus more on the real problems we have in our city. Like the crazy rising prices of everything that are causing more people then ever to be homeless. They need to put our tax dollars to good use and stop attacking a church that loves on everyone despite their personal preferences. These city officials should be ashamed of their terrible actions.

    strongly oppose. These council members have shown they are frauds and are quick to use taxpayers dollars on things as they please that brings nothing back into our communities only for their own benefit and gain. They have not stewarded any funds properly or legally and I’d hate to see them take ownership of a historical building and them treat it as they’ve treated the rest of Fresno.
