Adopt a finding of Categorical Exemption pursuant to Section 15301/Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA) guidelines for the project. 2. Approve a Resolution Establishing a Policy for the Preservation and Use of the Tower Theatre Property and Authorizing Purchase of the Tower Theatre Property. 3. Approve a Joint Litigation, Defense, and Indemnity Agreement by and between the City of Fresno, the Tower Theatre Entities and Sequoia Brewery 4. Approve a Purchase and Sale Agreement and Joint Escrow Instructions by and between City of Fresno, Tower Theater Productions, Fidelity National Title Insurance Company, and Tower Theatre Productions for the Performing Arts for real property at 1247 North Wishon (APN 451-265-02) and 777 East Olive Avenue (APN 451-265-03) for $6,500,000. 5. Approve a Purchase and Sale Agreement and Joint Escrow Instructions by and between City of Fresno and J&A Mash & Barrell, LLC., and Fidelity National Title Insurance Company for a portion of the real property at 777 East Olive Avenue (APN 451-265-03) for $1,200,000.

    The theater is already protected as it is registered as a historical landmark. This item on the agenda is an inappropriate amount of money to be used in such a way as being proposed. It is completely unethical and without merit. The money should be used to help the community members in which would benefit the most. The needy, the hopeless, the children, the schools, the churches! Not that which fuels the agenda of crooked council member and greedy community members.

    The city has no right to interfere in the sale of a privately owned business. This is ideologically and politically motivated by those who oppose and choose to discriminate against Christians. Those protesting the sale don’t even patronize the Tower Theatre. They think they own the neighborhood and do not want a Christian organization purchasing the theater, plain and simple. The city of Fresno is participating in gross religious discrimination and are violating constitutionally protected property rights through the missuse of eminent domain. This should not be allowed!

    The Tower theater is a cultural and historic landmark for our city. We need our community to be preserved as the open/accepting/nightlife place it is. I highly encourage and support the acquisition of Tower Theater by the city.

    I support the city’s acquisition of the Tower Theater in order to preserve it for future generations. I believe that the theater is a vital part of the community and it is critical that it remains an entertainment venue for the well-being of all surrounding businesses and Fresno as a whole.

    It’s so ridiculous that all of a sudden the city wants to I interfere with a private sale to a church that only uses the building on Sundays and 1 Wednesday a month. They are trying to abuse their power. It’s so ridiculous.

    I support the city’s purchase of The Tower Theatre. Preserving this historical landmark for the community and local businesses is so important. Adventure Church targeting Tower to proselytize and evangelize to the community will do (and has done) just the opposite of what they want. Please protect the theatre, the businesses, and the weird community we all know and love.

    Please do buy it! The area is not zoned for a religious structure—end of story. I don't know why this has been allowed to drag on. The city would certainly maintain this entertainment venue for all people of Fresno. I moved to the Tower specifically to be in a "friendly" place. The hostility and divisiveness I have seen since the start of this illegal sale is so discouraging. And frankly not Christian at all.

    I oppose Fresno City’s purchase of The Tower Theater. We need to focus on where our tax dollars should be spent and that is on our Community to improve Fresnos outlook the homeless, our family’s more important our children

    I oppose the city interrupting the private sale of the Tower Theatre to Adventure Church. There are more useful needs to spend our tax dollars on.
